Welcome to the Light Art Creators Platform (“Platform”). By accessing, registering, or using our services, you (“User,” “Brand,” “Creator,” or “You”) agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, please do not use the Platform.

1. Definitions

Platform refers to the Light Art Creators system, website, and related services.
Creators/Influencers refers to individuals using the Platform to receive brand collaboration opportunities.
Brands/Clients refers to companies or individuals using the Platform to book creators for campaigns.
Campaign refers to a collaboration, brief, project, or promotion facilitated through the Platform.

2. Eligibility

To use the Platform, you must:

Be at least 18 years of age.
Have full legal capacity to enter into binding agreements.
Provide accurate information during registration.
Comply with all laws and platform policies.

3. Account Registration

Users must create an account before accessing full platform features.
You are responsible for maintaining the confidentiality of your login details.
We reserve the right to suspend or terminate accounts for misuse, fraud, or violation of these Terms.

4. Platform Services

The Platform provides:

A marketplace for creators and brands to connect.
Tools for campaign management, communication, and payment processing.
Creator profile listings, analytics, and collaboration tracking.

The Platform does not guarantee bookings, earnings, or campaign performance.

5. Creator Responsibilities

Creators agree to:

Provide truthful profile information, including follower counts, audience insights, and content categories.
Deliver content according to the agreed brief, deadlines, and brand guidelines.
Disclose sponsored content in accordance with advertising and regulatory laws (e.g., #ad, paid partnership).
Not engage in fraudulent activities such as buying followers, fake engagement, or using banned content.

6. Brand Responsibilities

Brands agree to:

Provide clear campaign briefs, compensation terms, and required deliverables.
Pay for services within agreed timelines.
Not request illegal, harmful, or inappropriate content from creators.
Respect creator intellectual property unless usage rights are explicitly granted.

7. Payments & Fees

Creators may be compensated through fixed fees, commissions, or other agreed structures.
The Platform may charge a service/transaction fee from either party as stated during campaign acceptance.
Payments may be held in escrow and released upon campaign completion, unless otherwise agreed.
All financial transactions are processed through approved payment providers.

8. Content Ownership & Rights

Creators retain ownership of their original content unless rights are transferred.
Brands receive usage rights only as specified in the campaign agreement.
The Platform may use campaign content for marketing or case studies unless a written objection is submitted.

9. Prohibited Use

Users must not:

Post false, misrepresentative, defamatory, or illegal content.
Attempt to bypass the Platform (e.g., contacting partners outside the platform to avoid fees).
Engage in harassment, hate speech, discrimination, or copyright violations.
Upload viruses, bots, or perform system attacks.

10. Termination

We may suspend or terminate your account without notice if:

You violate these Terms.
Your activity harms the platform, users, or legal integrity.
Fraudulent or abusive behavior is detected.

Users may request account deletion at any time.

11. Limitation of Liability

The Platform is provided “as is” and we do not guarantee uninterrupted access or error-free performance.

We are not liable for:

Loss of revenue, reputation, or business opportunities.
Disputes between brands and creators.
Third-party failures (banks, payment processors, social platforms, etc.).

12. Privacy & Data Use

Your data will be collected, processed, and stored according to our Privacy Policy.

We do not sell personal data to third parties.

13. Changes to Terms

We may update these Terms at any time. Continued use of the Platform after changes = acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of Republic of Kenya

Any disputes shall be resolved through arbitration or courts in that jurisdiction.
